Men & Pregnancy Rights

Your girlfriend has just informed you she is pregnant - and you're the father. Now what? Before responding to the situation, gather the facts and know your rights and responsibilities.

How can I find out if my girlfriend is really pregnant?
You want to confirm her pregnancy. Home pregnancy tests are generally accurate but not always. Your girlfriend should see a doctor to be sure. Pregnancy centers like ours can confirm her pregnancy and help find appropriate medical care.
If my girlfriend is actually pregnant, do I have any rights?
Prior to the pregnancy you had the right to avoid conceiving an unplanned pregnancy. After your girlfriend conceives you have few rights.
How can I get my girlfriend to include me in the decision?
If your girlfriend excludes you from the decision making process it may be she feels hurt and angry with you. Family members and friends may also pressure her to not have you involved. If you reassure her that you care about her and show support, she may be more likely to involve you in her plans.
Do I have any say about my girlfriend considering an abortion?
Depending on your relationship with your girlfriend you may be able to influence her decision. However, as the baby's father, you have no legal rights to interfere with an abortion. If your girlfriend decides to have an abortion, she may do so without your knowledge or agreement. You can, however, encourage her to talk with a counselor at a pregnancy center like ours or call 1-800-395-HELP for the closest pregnancy center near you.

What about adoption?
Adoption is a viable option if you are not ready to parent. It is a legal process whereby both you and the child's mother terminate your rights for guardianship of your child. In most states, an adoption plan cannot take place unless you, as the father of the child, have been notified. You then have the right to agree or oppose the adoption plan.
What legal responsibilities will I have if my girlfriend decides to parent?
In most states, if your girlfriend chooses parenting, you are required to pay child support until the child is 18 years old. Consult with an attorney or the child support office in your state to learn specific details about your rights and responsibilities, filing for paternity, and other legal issues. In the State of Maryland contact the Child Support Administration at toll free 1-800-332-6347.
